Toni Atkins for Governor 2026 (“Campaign,” “we,” or “us”) is committed to protecting your privacy. Accordingly, this Privacy Policy explains how we collect, use, and disclose information about you when you access or use our websites, mobile sites, and mobile applications that link to this Privacy Policy (collectively, “the Site”). It does not apply to information we may collect offline, such as by phone or in person. This policy does not apply to information collected through any other website or to the practices of companies that we do not control.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy, and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). Collection of your Personal Information

Information You Provide to Us

We collect information you provide directly to us. For example, we collect personal information when you sign up to receive updates, request information, fill out a form, sign a petition, sign up as a volunteer, sign up for an event, create an account, participate in a contest or promotion, make a donation or purchase, communicate with us via third party social media sites, request support, send us an email, or otherwise communicate with us. Personal information is information that can be directly associated with a specific person or entity. The types of information we may collect include your name, contact information (such as email address, postal address, phone number, usernames, social media handles), location, credit card and other payment information (which may be collected directly by a third-party processor), and any other contact or identifying information you choose to provide.  You are not required to provide information directly to us in order to view the Site. The information that we collect from you through this Site will vary depending upon how you use the Site and what information you choose to provide to us. You may make changes to the information you have provided by contacting us info@toniatkins.org.

In addition, federal, state and local laws may require us to collect certain personal information from donors. For example, the State of California requires us to collect (and disclose to them) the name, mailing address, occupation, and employer of all individuals whose donations to the Campaign exceed $100 per calendar year.

Donations will be processed through ActBlue.com.  When you donate through ActBlue, you will need to provide your name, address, occupation and name of employer, credit card information, billing address, and confirm that we may legally accept your contribution based on the specific disclosures set forth on the ActBlue.com fundraising platform.  When donating through ActBlue, ActBlue will provide us with your name, address, occupation, employer, and any additional contact information that you use when donating, but not your credit card information.

Automatically Collected Information

When you access or use our Site, we may automatically collect information about you, including:

  • Log and Usage Information: We collect information related to your access to and use of the Site, including the type of browser you use, app version, access times and dates, pages viewed in the Site, your Internet Protocol (IP) address, and the page you visited before and after navigating to our Site.

  • We use IP addresses to analyze trends, administer the site, track web traffic, and gather broad demographic information for aggregate use. An IP address is a 32-bit number that identifies each sender or receiver of information and is sent in packets across the Internet.

  • Device Information: We collect information about the computer or mobile device you use to access our Site, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

  • Transactional Information: If you make a donation or purchase, we may collect information about the transaction, such as donation amount, purchase price, product details, and date and location of the transaction.

  • Information Collected by Cookies and Similar Tracking Technologies: We (and our service providers) use different technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in-device memory that help us improve our Site and your experience, see which areas and features of our Site are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that may be used in our Site or emails and help deliver cookies, count visits, understand campaign effectiveness, and determine whether an email has been opened an acted upon. Information We Collect from Other Sources

We and our service providers may also obtain information about you from other sources (such as social networking sites, databases, online marketing firms, and ad targeting firms) and combine that with information we collect about you on our Site. For example, if you create or log into your account through a social media site, we will have access to certain information from that site, such as your name, account information and friends lists, in accordance with the authorization procedures determined by such social media site. We may also use such information for list matching purposes. Other examples include demographic data, such as age range, gender, and interests; advertisement interaction and viewing data, such as ad click-through rates and information about how many times you viewed a particular ad; and unique identifiers, including mobile device identification numbers, that can identify the physical location of such devices in accordance with applicable law.

  • To solicit volunteers, donations, and support for the Campaign and for other candidates, issues, and organizations that we support and to connect you with other volunteers;

  • Contact you if Federal election laws require us to request additional information from you;

  • Remind you to vote and register to vote and assist you in finding your registration information, polling location, and campaign events near you;

  • Monitor and analyze trends, usage, and activities in connection with our Site;

  • Personalize the Site and provide advertisements, content, or features based on your preferences, interests, and browsing and online activities;

  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Campaign and others; and

  • Carry out any other purpose described to you at the time the information was collected.

Sharing of Information

Information about our donors and website visitors is one of our most important assets and therefore we keep it confidential. We may share selected information about you as follows or as otherwise described in this Privacy Policy:

  • With vendors, service providers, volunteers, and consultants who need access to such information to carry out work on our behalf;

  • With organizations, candidates, campaigns, groups, or causes that we believe have similar political viewpoints, principles, or objectives or share similar goals and with organizations that facilitate communications and information sharing among such groups;

  • To report required information to government agencies, including name, mailing address, occupation, and name of employers of individuals whose contributions exceed $100 in an election cycle (or other lower threshold if applicable);

  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security, compliance or law enforcement requirements;

  • When we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests, claims, or legal authorities, including responding to lawful subpoenas, warrants, or court orders;

  • If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property, and safety of the Campaign, its employees, volunteers, constituents, or others;

  • To protect our donors and supporters from fraudulent, abusive, or unlawful conduct; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires the disclosure of communications or records

  • In connection with, or during negotiations of, any reorganization, formation of new committee or successor organization, asset sale or transfer, financing or lending transaction, or in any other situation where personal information may be disclosed or transferred as one of the assets of the Campaign;

  • With your consent or at your direction. We also may be required to disclose personal information in order to carry out your requests when you use the site.  This may include sharing your personal information with our third-party vendors.  For example, we may share personal information with third parties as necessary to deliver you email updates.

  • We may also share aggregated or de-identified information that cannot reasonably be used by those third parties to identify you.

Collection and Use of Children’s Personal Information

We care about the safety and privacy of children online, and we comply with the Children’s Online Privacy Protection Act of 1998 (COPPA).  We do not knowingly collect personal information from children under the age of 13.  To respect the privacy of children and to comply with COPPA, children under the age of 13 should not provide any personal information on this site.  We urge parents to supervise their children while online.

Your Choices

Updating Information.  You may update and correct certain information you provide to us by emailing us at info@toniatkins.org.  If you wish to delete information we have collected from you, please email us at info@toniatkins.org, but note that we may retain certain information as required by law or for legitimate campaign purposes.  We may also retain cached or archived copies of information about you for as long as necessary for our business purposes.

Mobile Push Notifications and Alerts.  With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device.  You can deactivate these messages at any time by changing the notification settings on your mobile device.

Messaging. You may opt out of receiving text messages, updates and newsletters by following the instructions in those emails or text messages. If you opt out, we may still send you other types of emails, such as those about your use of the site or any donations or transactions.

Message Board. Additionally, in the event that we offer a message board or any other interactive or social-type feature on a website administered directly by us, please be aware that these areas may allow you to publicly post, and share with other users, certain messages, content, or other information (e.g., stories, pictures, etc.). Although we may take certain precautions to protect those who use these areas of one of our websites, we encourage you to be wary of giving out any personal information in such public forums. Your California Privacy Rights

How We Respond to Do Not Track Signals for California Residents.  California Business and Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how we respond to “Do Not Track” browser settings.  We do not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed.  We continue to review new technologies and may adopt a standard once one is created.
